person or person, to be trustee or Trustees, Subject to
the approval of the Majority of the Bondholders
as aforesaid, and so on untill Trustees Shall
be appointed to the Satisfaction of Such Majority
Provided, Nevertheless, and it is hereby declared
and agreed, that in Case it shall at any time here
=after prove impracticable after reasonable exertions,
to appoint in the manner herein before provided, a
Successor in case a Vacancy may have happened
in Said Trust, application in behalf of all the
holders of the Bonds Secured hereby may be made
by holders of the Bonds Secured hereby to the aggre
=gate amount of One hundred thousand dollars,
to any Circuit Court of the United States, or to any other
Court of Competent jurisdiction for any Judicial
district in which any part of the aforesaid Rail
road may be situated for the appointment
of New Trustees, And it is further agreed that
each of the Trustees is to be held liable for his own
acts, and not for the acts of the other Trustees, and
that neither Trustees shall be liable for the acts of
any agent or agents appointed by them, in good
faith, to execute the powers Conferred upon them
by this deed - In Witness Whereof, the said
party of the first part has caused its Corporate
Seal to be affixed to these presents, and the same to
be attested by the Signature of its president and
Treasurer, and the said parties of the Second part
have hereunto Set their hands and Seals, to testify
their acceptance of the said Trust, the day and
year first above written

Signed Isaac K. Roberts a Commissioner of the
State of Florida in the City of New York to take
acknowledgements of deeds to be recorded in
Florida, personally appeared Marshal O. Roberts
Known to me to be the President of the Florida Rail
road, who being duly sworn did depose and say
that he is President of the Florida Rail
Road, that he Knew the Corporate Seal of the
Said Company, that the Seal affixed to the above
instrument in writing was Such Corporate Seal
