agreed and obligated himself to place the said contract for rent in
writing, so as to secure the said rent beyond all doubt or mistake
Therefore, the said Wilk Call for and in consideration of the
sum of five dollars in hand paid and for the consideration
hereinafter mentioned agrees to rent to the said Jac L. Krimminger
of Alachua County the June plantation near Gainesville with
the use of the corn, fodder, stock, Horses Mules Waggons and
implements for the year one thousand eight hundred & Sixty nine
The said Krimminger agrees to the pay the said Call for the rent
of the said plantation, and the use of said personal property for
the year Eleven bags of long Staple Cotton of the average quality of the Cotton
raised on the place, the bags to average a weight of three hundred & fifty
pounds each. The said Krimminger also agrees that the said place
shall be planted or that the same is planted with Long Staple seed
of fair quality. The said rents shall be due and payable out of
the Crop raised on said place, and as the same is gathered
and a a Lien shall rest on the entire Crop untill the rents are paid
  In the execution of this agreement it is understood that Krimminger
insists that the original contract or proposition of the early part of
January on which the contract was made, was that the Corn &
Fodder was not to be returned, but that the eleven bags of Cotton
was to be a payment for it as well as for the rent, And in as much
as the said Call is not now purposed definitely to determine this
point, it is agreed that the question whether the Corn & Fodder is
to be returned, or whether it is to be paid for by the Eleven
bags of Cotton hereinbefore mentioned shall be left open for future
agreement, and untill the same is settled, the said Corn shall
remain in possession of said Krimminger

    Know all men by these presents, That for and in Consideration
of the sum of Five dollars to me in hand paid and received
and for advances made and agreed to be made to me, I have
assigned, and do hereby transfer and assign to F.W. Sims & Co
of Savannah Geo the bill of sale executed to me by
Danl R. June and John E. & Elizabeth Peay, and Mary B. June
pr J.L. Black Atty in fact selling and conveying to me eleven
bags long Staple Cotton rents of June place in Alachua County
Fla for the year 1869 - which are secured by the Contract
and agreement of J.L. Krimminger of this date which said
contract has relation back to the first day of Jany A.D.
1869. This Assignment and transfer also has relation
back to the early part of the month of May, when
the agreement with F.W. Sims & Co was made and the
