between the contracting parties
Second The said Watson Porter and DeWarren Barton are joint
proprietors and owners of land and tenements, horses
Mules, waggons, Carts, Saddles ploughs, hoes, gear
farming utensils &c as will appear by reference to their
deeds of Conveyance of record in the office of the Clerk of
the Circuit Court in and for the County of Alachua and
State aforesaid, the said parties each owning possing
One half interest in the Same and the said parties shall
Continue to be owners of their joint property in the proportions
mentioned; and in case of any addition being made to
the same by Mutual Consent the said parties Shall each
advance One half of the Cost thereof
Third All profits which may accrue to the said partnership
Shall be equally divided and losses happening to the
Said firm whether from bad debts, depreciation of
goods, loss of Stock upon plantation or any other cause
or accident, Shall be borne in the proportions herein
before mentioned of their interest in the above named
property
Fourth The said Watson Porter Shall devote and
give all his time and attention in the interest of the
Said firm - with the exception of any cases Superintend
-ence or directions of his farming interest - that is to
say, That any and all Sums of money realized by
him as a Compensation for any and all Services
performed by him in any Capacity whether by Salary
or otherwise, Shall be contributed to the general co-
partnership fund and equally divided between the said
parties - And the said DeWarren Barton shall
devote his entire time and attention in the interest of
the said firm - any and all Sums of money realized
by him as a Compensation for any and all Services per
=formed by him in any Capacity whether by Salary or otherwise
Shall be computed to the general copartnership fund
and equally divided between the said parties, and
the Said DeWarren Barton Shall likewise have and
exercise a general Superintendence of the agricultural
interest of the said firm ~~
Fifth All the purchase Sales transaction and account
of the said firm Shall be Kept in regular books for
that purpose, which Shall always open to the inspec
-tion of both parties, and their legal representatives, respe
-ctively, an account of Stock Shall be taken and an
account between the said parties Shall be Settled, as
often as once in each and every year, and as much
oftener as either partner may desire, and in writing
request
