Alachua County     }  To all whom these presents may concern, that I,
                      Garth W. James in the aforesaid State, Send Greeting-
Whereas, the said Garth W. James in and by a certain promissory Note
bearing date 27th day of August A.D. 1870, stands firmly indebted
unto Chas H. Appleton in the full and just sum of Five Thousand
Dollars, as in and by said Note, whereof refference being thereunto had, will more
fully appear - Now Know all men, that, I the said Garth W. James in con-
-sideration of the said debt and sum of money aforesaid, and for the better se-
-curing the payment thereof of the said Chas H. Appleton according to the
tenor and effect thereof; and also in consideration of Five (5.00) Dollars
to me the said Garth W. James, in hand well and truly paid by the said
Chas H. Appleton at and before the sealing and sealing delivery of these presents
the receipts whereof is hereby acknowledged, Have granted, bargained, Sold and
released; and by these presents do grant, bargain sell and release, unto the
said Charles H. Appleton all that tract or parcel of land lying and being
situate in the County of Alachua and State aforesaid, Known and described
as follows Viz: The S1/2 of Sec 32, T.7 R20 East; the NW1/4 of NE1/4 and North
1/2 of NW1/2 of Sec 5, lots No 1, and N1/2 of lot No 2, Sec 6, T.8S. R20 E the NE1/4
of NE1/4, and SE1/4 of NE1/4 of Sec 5. T.8.S. R20E. - SW1/4 of NW1/4 of S.5.T.8.S.
R20.E.- N1/2 of lots No 3, 11, & 12, & lot No 3 of Sec 6. T.8.S.R20.E. and NW1/4 of
SE1/4 of Sec 5.T.8.S.R20.E. ---- together with all and singular the rights
members, hereditaments and appurtenances to the said premises belonging
or in anywise incident or appertaining - To have and to hold: all and
singular the said premises unto the said Chas H. Appleton his heirs and
assigns - And I the said Garth W. James do hereby bind myself, my heirs,
executors and administrators, to warrant and forever defend, all and
singular the said premises unto the said Charles H. Appleton his heirs
and assigns against the lawful claims of all persons whomsoever -
  Provided always and nevertheless, and it is the true intent of the parties
to these presents, that if the said Garth W. James do and shall well and truly
pay unto the said Charles H. Appleton the said debt or sum of Money
aforesaid, at the time of its becoming due, according to the tenor and effect
of said promissory note, which is an evidence of indebtedness; then this
Deed of bargain and Sale shall cease, determine and be utterly null and
void otherwise it shall remain in full force and virtue -

well known who acknowledged that he signed, sealed and as his act and Deed,
delivered the within written deed, and that the same was executed by him for

Know all men by these presents that I Charles H. Appleton the mortgagee named in the within mortgage do hereby acknow-
ledge that I have received of Gath W. James the within named mortgager full payment and satisfaction of the same and in consid
eration thereof do hereby cancel and discharge said mortgage and release and quit claim unto the said James and his heirs and
assigns forever the premises therein described - witness my hand and seal this twenty Eighth day of March A.D. 1871

on the twenty Eighth day of March A.D. 1871, personally appeared before me Charles H. Appleton to me personally
known to be the person described in and who has Executed the above discharge and then and there acknowledged
to me that he Executed the said instrument of discharge freely & voluntarily for the purposes and uses
