This Indenture made this the Eleventh day of
November Eighteen hundred and Sixty Seven
Between Thomas W. McCaa, of the County of Alachua
and State of Florida of the first part, and T.A. McDonell
of the Same County and State party of the Second
Part, Whereas the Said Thomas W. McCaa is Justly
indebted in Sundry deeds and Consideration
sums of money and has become unable punctually
to pay and discharge the Same and is desirous
of making ***** Just and Equitable distribution
of all his property and Effects among his
Creditors, Now therefor this Indenture Witnesseth
that the Said Party of the first part, in Consideration
of the premises, and of the sum of one Dollar to
him in hand Paid by the said Party of the Second
Part, the receipt whereof is hereby acknowledged have
granted bargained covenanted, released sold assigned
transferred and Set over and by these Presents do grant
bargain Covenant release Sell assign transfer and
set over unto the Said T.A. McDonell of the Second
part and to his heirs and assigns forever all and
Singular the lands tenements hereditaments and
appurtenances Situate lying and being in the
County of Alachua Known and described as follows
to wit: Section thirty four Twenty Eight and Twenty seven
Township nine Range Twenty excepting the SW qr
of Section Thirty four, and the South West half of the SW qr
of Section 28, To Have and To Hold, the same and
Every Part and Parcel thereof with the appurtenances thereunto
belonging to the said Party of the second part, his heirs Executors
administrators and assigns, In trust nevertheless, for
and upon the following uses and Purposes namely, the
said Party of the Second Part, to take possession of all
and Singular the lands tenements and hereditaments
hereby assigned and Sell and dispose of the Same
upon such terms, and Conditions as in his
Judgement may appear best, and most for the interest
of the parties concerned and convert the Same into Cash
and thereupon Execute acknowledge and deliver all
Conveyances receipts and instruments, necessary and
proper in the premises for the purposes aforesaid
and by and with the avails and Proceeds of
such sales, to pay or cause to be Paid, first all
the Just and reasonable Expences costs *********
and charges of Executing and Carrying
out the objects of this assignment and all
Taxes with the land shall be sold and
disposed of according to this assignment
