State of Florida } This Indenture made and entered
Alachua County } into this the ninth day of December
A.D. 1872 between Henry S. Harmon of said State and
County as referee as hereinafter of the first part and
Newton Williams and Howard Todd of the State of
Kentucky parties of the second part Witnesseth That
whereas on the tenth day of October A.D. Eighteen hundred
and seventy one (1871) a Judgment was granted in the
Circuit Court of said County and State in the following
action viz Newton Williams and Howard Todd Plffs
Against
Geo L. Barnes in his own right and as Ex officio
Administrator of the estate of Isaac B. Nichols
decd and James B. Dawkins and James
B. Brown Defendants
in favor of the said plaintiffs and against the said defen
dants for the foreclosure of a mortgage in favor of said
plaintiffs and filed in the Judgment Roll of said ac=
tion and whereas the said party of the first part was
by the terms of said Judgment duly appointed by the
Judge of said Court as referee to sell the premises mentioned
in said mortgage to satisfy said plaintiff in the sum of seven
hundred and twenty two dollars and forty Cents and also
the sum of sixty five dollars and forty four cents the costs
of said action together with the interest on said Judgment
from the date thereof and whereas the said party of the
first part in pursuance of the terms of said Judgment
did duly and legally give public notice of the sale of said
mortgaged premises for the purposes aforesaid, And where
as on the fourth day of December A.D. 1871 it being the
first Monday in said month the said party of the first
part in pursuance of said Judgment did proceed to sell
said mortgaged premises at public outcry and whereas
the said parties of the second part at the time and place
of said public sale did bid the sum of Eight hundred
and fifteen dollars for said mortgage premises it being
the highest and best "bona fide" bid made for the same
and thereby became the purchasers thereof for the said
sum of Eight hundred and fifteen Dollars
