Whereas Henry B. Scott late of New York City did on the 18th day of
December AD 1869 - Execute and acknowledge a Deed to William
Birney for two thousand five hundred and twenty acres of land lying
in Sections 19-20-29-30-31 & 32 - of Township seven (7) south Range
20 East in the County of Alachua Florida as will more fully appear
by reference to said Deed recorded herewith in the records of said
Alachua County; and whereas the consideration of said Deed was
not cash but the Estimated value of a City lot situate in the
City of Morris Illinois of a farm of Three Hundred and Eighty one
acres situate in the County of Grundy Illinois and of certain
Chattels in said farm all of which property viz: The lot farm and
Chattels were the absolute property of Catherine H. Birney wife of the
said William free from all claim of life Estate or other claim
whatsoever in the party of the said husband as will fully appear in
regard to the real Estate by Deeds duly recorded in the Deed Records
of said Grundy County for 1861 & 1868 and in regard to The Chattels
by Evidences That they were purchased with the proceeds of sales of
real Estate in Bay City Michigan belonging since 1854 to one said
Catherine; and Whereas the said H.B. Scott Executing his deed in
New York City at a great distance from the said Catherine and William
made by mistake the said William grantee therein instead of the
said Catherine who should have been made grantee in said Deed
free from all claim of life Estate or other claim whatsoever of her
husband and free from his interference or control which mistake
the said Scott has hitherto neglected and refused to correct, and
Whereas the said Catherine H. Birney desires that of the land conveyed
to the said William Birney by the said Scott he the said William
shall retain the legal title to one hundred and sixty acres the same
to be held by him as the head of the family as a homestead for said
family with all the rights belonging to the Estate of homestead according
to the constitution and laws of the State of Florida.
Now therefore I William Birney for the purpose of correcting
the mistake aforesaid and that said Real Estate with one Exception
set forth may be conveyed to the said Catherine H. Birney her
heirs and assigns to her sole and separate use free from all life
Estate and all claim interference or control on my part and
in consideration of one dollar to me paid by Leonard G. Dennis
of The City of Gainesville Florida the receipt whereof is hereby ac-
knowledged have given granted bargained sold aliened released
conveyed and confirmed and by these presents do give grant bar-
gain sell alien release convey and confirm unto the said Leonard
G. Dennis party of the second part and to his heirs and
assigns forever all that piece parcel and tract of land lying
and being in Alachua County Florida and known and described
as follows: Lots ten (10) Eleven (11) and twelve (12) in section nineteen (19)
the south half of section twenty (20) The west half and the west half
of the east half of section twenty nine (29) The north west quarter and
west half of North East quarter of section Thirty two (32) lots one (1)
Two (2) Three (3) and North half of Lots five (5) six (6) seven (7)
