(12) in section Thirty (30) all in Township seven (7) south Range Twenty
(20) East and containing according to Government survey Twenty three
hundred and sixty (2360) acres. Together with all and singular the Ten-
ements and appurtenances belonging or appertaining thereto and the re-
versions remainders rents issues and profits thereof and also all the
Estate right title and interest property possession claim and de-
mand whatsoever of the said party of the first part of in and to the
same and Every part and parcel thereof - To have and to hold all and
singular the above granted and described land and premises with
the appurtenances unto the said party of the second part his heirs and 
assigns to their only proper use benefit and behoof forever - and the said
William Birney doth for himself his heirs Executors and administrators
covenant and Grant to and with the said party of the second part
that the premises herein conveyed are free and unincumbered of
and from all grants mortgages judgements liens charges and incum-
brances whatever made or suffered by him the said William
  In witness whereof the said party of the first part and Catherine his
wife who signs to Express her assent to the Exception of the homestead
from the granted have hereunto set their hands and seals the day and

December in the year Eighteen Hundred and seventy before me a Justice
of the Peace in and for said County personally appeared William Birney
and Catherine H. Birney his wife being known to me to be the individuals who
Executed the above deed and acknowledged that they did Execute the
said deed for the uses and purposes therein Expressed and the said Catherine
H. Birney wife of the said William being by me first privately Examined sep-
arate and apart from her said husband and having the said deed
also fully explained to her in said Examination acknowledged that the
foregoing conveyance Executed by her was and is made freely voluntarily
and without any Compulsion restraint apprehension or fear of or from
her said husband and that she is still satisfied therewith.
