on the 11th day of March AD 1856 filed in the
Circuit Court for the Eastern Circuit of Florida
Putnam County a Petition for the Partition of
certain lands herein mentioned and described
according to the respective right of the parties
interest therein and for the sale of such pre-
mises if it should appear that partition could not
be made without great prejudice to said parties
pursuant to the Statutes in such cases made
and provided. And such proceedings were there
upon had in said Court that a Decree was
duly made therein that partition of said pre-
mises should be made according to the several
rights and interests of said parties to these presents
being qualified were by the said Court appointed
Commissioners and whereas the said cause having
been moved to the circuit court of Duval County
Florida, such proceedings were afterwards had therein
that said Commissioners were by a Rule of the
Court last aforesaid, ordered and instructed to sell
said Lands at Public auction to the highest bidder
giving notice of the time and place of such sale accor
ding to law and whereas the said commissioners pur
suant to the said order of the said Court did after
having given public notice of the time and place of such
sale on the 5th 6th and 7th days of April 1869 at the
City of Jacksonville Duval County Florida expose
for sale at public auction all and singular the lands
described in said petition at which sale a portion of
the said premises being the same hereinafter described
were struck off to one Samuel C.C. Chambers: And
whereas the Commissioners having reported the sale
made by them as aforesaid a Decree was rendered in
said cause on the 9th day of March 1870 confirm
ing the same and directing said commissioners to execute
Deed to the said purchasers of the Lands purchased
by them respectively, provided nevertheless, that no
Deed of conveyance should be made and executed
by the said Commissioners to any premises or purchasers
of said Lands not being an heir to said Moses E.
Levy and as such, entitled to a distributive share
in said Estate, until all moneys due by such purchasers
