This Indenture made this 20th day of February in the
year of our Lord 1875. Between George R. Fairbanks, of
the County of Franklin and State of Tennessee party
of the first part and Thomas B. Ellis of Alachua Coun
ty Florida party of the second part= Witnesseth:
That the said party of the first part in con-
sideration of the sum of Two thousand Dollars>
nine Hundred dollars lawful money of the
United States, hath granted bargained and
sold and by these presents doth grant, bar
gain and sell unto the said party of the second
part, his heirs and assigns forever all the
following described premises to wit: section Number
seven (7) in Township No. Ten of Range No. Twenty
South & East containing 578 87/100 acres, and also
fractional section No. Eighteen (18) of Township no. Ten
of Range No Twenty South & East containing 108 80/100
acres - being part and parcel of the Aradondo Grant in
the County of Alachua and State of Florida, with all
the appurtenances thereto belonging being the same
premises described and conveyed in a certain
Indenture made by S.F. Halliday Refree &c to the party
of the First part bearing date the 3d day November 1873
and recorded in Alachua County Clks office on the
5th day of November 1873 in Book I of conveyances page
135 and and a part of which said lands to wit, the North
Half of section 7 T 10 R 20 were conveyed to the party of the
first part by S.F. Halliday by virtue of a Tax Deed on the
1st day of January A.D. 1875 and recorded on the 2d day
of Feby 1875 in Book I page 395 of Deeds of Alachua County
with all the rights, privileges and appurtenances thereto belonging
or in any wise appertaining.
To Have and to Hold the aforesaid premises to the said party of
the second part, his heirs and assigns in fee simple forever.
and I the said George R. Fairbanks for myself and my
heirs, executors and administrators do covenant with the said
party of the second part and his heirs and assigns that I
am lawfully seized in fee of the aforesaid premises, that they
are free from all encumbrances that I have a good right
to sell and convey the same to the said party of the
second part and that I will and my heirs executors and
administrators shall warrant and defend the same |
