great prejudice to said parties pursuant to the Statutes in
such cases made & provided & whereas such proceeding are
thereupon had in said Court that a Decree was duly made
that partition of said premises should be made according to the
several rights & interests of said parties & thereupon to make partition
the parties of the first part to these presents being qaulified
were by the said Court appointed Commissioners & whereas such
proceedings were afterwards had in said cause that on the
9th day of March 1870 a final Decree was rendered therein
by the Court approving certain sales of said lands made by the
Commissioner under order of said Court & whereas in and by
said final Decree is among other things further considered by &
adjudged that the said Ramah DaCosta & the heirs of
Rachel Putter are entitled to all the rights and interests of
the Estate of Moses E. Levy in & to certain lands in Alachua
County being the same which are hereinafter described or to the
consideration for which the same may be sold that David L.
Yulee Admr do proceed with delay & prosecuted the sus
pending in the Circuit Court for Alachua County for the recovery of
said lands to final Judgment or Decree & that legal conveyance
be made & executed to the said Ramah DaCosta and the heirs
of Rachel Putter to lands in Alachua County in the aforesaid
suit pending for their recovery should be delivered of the same
be recovered And whereas the said suit pending in Alachua
County was by the said Admr prosecuted to final Judgment
& the said Alachua lands recovered to the said Moses E. Levy
& whereas application has been made to the said Commissioner
for a Deed of Conveyance to Ramah DaCosta party hereto
of the second part of her her interest in said lands
Now therefore this Indenture Witnesseth that the said
Commissioners hereto of the first part in pursuance the decree of
said Court made as aforesaid in consideration of the premises &
the sum of one Dollar to them in hand paid have granted,
sold conveyed & confirmed unto the said party of the second part her
heirs & assigns forever one undivided half interest in certain lands
situated in Alachua County State of Florida & described as
follows to wit:- Section Eight (8) Frac section twenty two (22)
Frac Section two (20) Frac Section three (3) & Section Eleven (11)
all in Township nine (9) South of Range nineteen (19) East
Containing about two thousand one hundred & ninety (2190) acres
together with & singular the tenements & appurtenances to the same
belonging or in any wise appertaining and the reversion & reversions |
