Memorandum of agreement made this 1st day of Feb
ruary 1878 by & between John W. Hudson of Madison &
Safferd, & Joseph Mackey all of Wisconsin parties of the
first part and William Ellis of Alachua County State
of Florida party of the 2nd part
Witnesseth That said first party in Consideration
of seven hundred and fifty dollars paid them by said 2nd party
the receipt of which is hereby acknowledged and the further
sum of seven hundred and fifty dollars to be paid one
half in one year from the date hereof the balance in
two years from said date with interest to be paid annually
at rate of ten percent hereby agree to sell and Convey to
said second party subject to accruing taxes all their right
& interest in & to that portion of what is known as the Ed Haile plan
tation situate in Alachua County State of Florida & Conveyed
to Joseph Mackey and John W. Hudison by W.S. Main
of Madison Wisconsin as assignes of the Bank of Mad
ison by deed dated April 28th A.D. 1877, & recorded in the
office of Register of Deeds of the said County of Alachua
in Volume "J" of Deeds page 803, the portion of said
premises so contracted is described as follows Begin-
ning at a stake at the South East Corner of the Maxey
Dell tract on section line north & South running north
twenty Eight degrees East twenty Seven 61/100 chains then
East on section line Eighteen 50/100 chains to a stake at the
North East Corner at the Maxey Dell tract = thence South
forty nine degrees and forty five minutes west forty chains
to the place of beginning Containing twenty four acres more
or less, Also the following described premises to wit:
Beginning at a stake on the Section line running North and
South between Section 26 and 27 of Township ten (10) South
of Range 19 East and running South 40° 0 15' East 9 Chains
and 121 links to a Stake thence North 71° - 45' East (41)
Chains and 34 links to a stake thence 49° - 45' East
208 2/3 feet to a Stake thence North 40° - 15' West 25 Chains
to a Stake and thence along the Northern boundary of the
"G.I.F. Clark Grant" 40 chains to point of beginning
containing 74 acres more or less in Alachua County State
of Florida Excepting and reserving over & across said prem-
ises for purposes of a road or public highway the road as
it now runs over & across the same until it Strikes the line
then to follow the line till it Strikes the McIntosh Grant the
said Strip so reserved for said purpose to be thirty three feet
in width the said so to be given to contain covenants against
all incumbrances made by said first parties or suffered
by said first parties except accruing taxes which said
2nd party agrees to pay & not suffer to be returned for
non payment
Second party to have immediate possession but not to
Commit or suffer to be committed any waste thereon
