and the party of the first part covenants and agrees not to disturb or molest the
party of the second part, its successors and assigns servants agents or
employees in the use and enjoyment of the said way or privileges. To have and
to hold the above granted premises and privileges unto the party of the
second part its successors and assigns against all and every person or persons
lawfully claiming or to claim by or through the party of the first part.
Provided, however, that if the party of the second part its Successors or assigns
shall not within One Year from the date hereof locate grade and tie its Rail
Road over or within ___ miles of the above described premises this grant and
conveyance to be wholly void and of no effect. In Witness Whereof the party

Alachua County } Charles Williams of the County of Alachua and State of Florida and
wife Chaney Williams of the first part and Thomas Eales of the same County and State
of the second part Witnesseth: that the said party of the first part in consideration
of the sum of Two Hundred and fifty dollars in hand paid the receipt whereof
is hereby acknowledged have granted bargained sold, and by these presents
do grant bargain and sell unto the said party of the second part his heirs and
