thereunto belonging unto the said party of the second part and his heirs
and assigns as their absolute property in fee simple forever and the said
Saml A Swann for himself and for all other claiming by through or under
him does covenant and agree that he is seized in fee simple of a good and
indefensible estate in and to the above premises by deed from above Edwin Magrath
recorded Book H page 463 and that he has conveyed the same free and
discharged from all encumbrances and liens of any and every nature and
description created by himself and that the said party of the second
part his heirs and assigns shall quietly and peaceably enjoy the above
described premises against all persons whomsoever lawfully claimed by, through
or under him the said party of the first part. In testimony Whereof the said

State of Florida}Whereas I G P Thomas was by an order of the County Court in of
Alachua County  } for said State & County made and rendered on the 25th day of May
AD 1875 duly appointed and authorized as commissioner to make a sale of the
lands hereinafter described belonging to the estate of Stephen McCall late of said
County & State deceased for division between the heirs at law of said estate; And
whereas as such Commissioner I did duly advertise said land for sale on the
first day of July AD 1878 according to law and did pursuant to said notice duly
sell the same at public outcry before the Court House door in the town of
Gainesville Florida as such Commissioner: And whereas at said sale Thomas
Dodd became the purchaser of this particular parcel of land hereinafter described
at and for the sum of Three Hundred ($300.00) Dollars that being the highest
sum bid for the same at said sale he being the bidder thereof: And
whereas said sale has been duly confirmed by an other order or said
County Court made & rendered on the 30th day of August AD 1878: And I the
said G P Thomas as such commissioner duly authorized to make and
