Charles W. Brush to Mary R. Thomas
"Deed"
This Indenture made this Seventeenth day of December in the Year
eighteen hundred and Seventy nine between Charles W. Brush at
present of the City of San Francisco and State of California Executor of
the last Will and Testament of Nehemiah Brush deceased of the first
part and Mary R. Thomas wife of R.Y.H. Thomas of the town of
Gainesville Alachua County and State of Florida of the second part:
Whereas Nehemiah Brush by his last Will and Testament, dated the
tenth day of March in the year eighteen hundred and forty three
duly admitted to probate and now of record in the office of the Clerk
of Alachua County and State of Florida authorized and empowered
his executors therein named to sell and convey certain real estate
also in said Will named. And Whereas the party hereto of the first
part, the surviving Executor named in said Will, by virtue of such
authority has sold to the said party hereto of the second part a
portion of said real estate which is herein after described for the
sum of Four hundred (400) Dollars which amount has been fully
paid by the said party of the Second part as is hereby admitted
Now therefore this Indenture witnesseth: that in consideration of the
premises and of one dollar the said party hereto of the first part
Executor as Aforesaid doth grant, bargain, sell, alien, release, Convey
and confirm unto the said party hereto of the second part her heirs
and assigns forever In Fee all that lot or parcel of ground situate and
lying in Brush's addition to Gainesville in Alachua County
State of Florida being a portion of a Tract of Land known as "The
Arredondo Grant" and described as follows, that is to say: Lot number
four (4) in Brush's addition to the Town of Gainesville being about four
hundred feet (400) north and South by two hundred and Six feet (206) East
and West be the same more or less. It being a part of the same Ground
which by a decree passed in the case of Brush et al against Prall et al
in the Circuit Court of St John's County and State of Florida, on the
eleventh day of August, in the Year eighteen hundred and forty nine
which decree has been duly recorded in the Clerk's office of Alachua County
in Said State was adjudged and apportioned as the property belonging
to the estate of the said Nehemiah Brush deceased. Together with all
and singular the rights privileges advantages tenements hereditaments
and appurtenances and the reversion and reversions remainder and
remainders rents issue and profits thereof; and also all the estate right
title interest claim and demand whatsoever both in law and equity
which the said testator had in his lifetime and at the time of his
decease and which the said party hereto of the first part hath by
virtue of said last Will and Testament or otherwise of in and to the same
and every part thereof with the appurtenances. To Have and to Hold the
above described lot or parcel of ground with the appurtenances unto the
said party hereto of the second part her heirs and assigns forever
And the said party hereto of the first part as Executor aforesaid
