T.C. Ellis and Wife To the Florida Southern Railway Company
"Deed"
State of Florida } This Indenture made the 2d day of Dec AD 1881 between T.C. Ellis
Alachua County } and Sarah A. Ellis his wife parties of the first part, and the Florida
Southern Railway Company the party of the second part. Witnesseth: That the parties of
the first part in consideration of the sum of one dollar paid by the party of
the second part have bargained, sold, granted, and conveyed, and do hereby bargain,
sell grant and convey unto the party of the second part, its successors and assigns
a strip or parallelogram of land for its Railway right of way one hundred and Twenty
feet in width at whatever point or points the party of the second part may see proper to
locate the same, of, in upon, over and through the following described land Situated
lying and being in Alachua County in the State of Florida and particularly described
as follows, to wit: all of Section 29 - Range 20- Township 9 In Arredondo Grant, to enable
the party of the second part its successors and assigns to build construct have
hold use and operate a Railway in upon over and through the said land said
way shall be as aforesaid 120 feet wide and shall be located as aforesaid by the
party of the second part its successors and assigns and all and every person for
its benefit and advantage at all times hereafter to construct use pass and repass
with and without property and effects through and over a Railway lately surveyed
or located or to be surveyed and located by the party of the second part in upon
over and through the same and the party of the second part its successors
and assigns hereby has and shall have the right and privilege in consideration
aforesaid and in consideration of its construction and operation of said railroad
to go beyond the limits of the said 120 feet or way hereby granted and released
to drain said way and perpetually to keep it drained and the parties of the
first part covenants and agrees not to disturb or molest the party of
the second part its successors and assigns servants agents or employees in the use
and enjoyment of the said way or privileges. To have and to hold the above granted
premises and privileges unto the party of the second part its successors and
assigns against all and every person or persons lawfully claiming or to
claim by or through the parties of the first part. Provided however That if
the party of the second part its successors or assigns shall not within Two
Years from date hereof locate grade and tie its Railroad over through or
across the above described premises, then this grant and conveyance to be
wholly void and of no effect. In Witness Whereof the parties of the first part have

and private examination say and acknowledge before me that she did sign
