first part all of the timber upon said land together with twenty acres more or less
wherever he may locate his Mill and residence to be taken and reserved from his half
interest Giving and granting to the parties of the second part the right to use all
timber necessary for ties in the Construction building and operating their said road
the whole way through said land containing 1280 acres of land more or less
together with all and singular the tenements hereditaments and appurten-
ances to said land belonging or in anywise appertaining, Provided that if the
party of the second part its successors or assigns shall fail to locate construct
and have in actual operation its Railway across said land within one year
from the day of this instrument then this instrument is to become void. To the
faithful performance of all of which the parties of the first part does hereby solemnly
covenant obligate and bind themselves heirs executors and administrators firmly by

J.E. Johnson wife of Hiram Johnson and who being first duly questioned and
examined by me separate and apart from her said husband did upon such Separate
and private examination say and acknowledge before me that she did sign
seal execute and deliver the foregoing instrument of writing for the purpose
of releasing relinquishing and renouncing all of her claim to Dower and to all
other claims rights or interests that she may have in the land in Said
instrument described and that she did sign seal execute and deliver said
instrument for the purpose aforesaid freely and voluntarily and without any
compulsion constraint apprehension or fear of or from her said husband
