Gainesville situated in the County of Alachua State of Florida party of the
Second part Witnesseth: that whereas the said party of the first part did
by his deed executed on the 1st day of March AD 1866 a copy of which is spread
upon the record of deeds book "E" in the office of the Clerk of the Circuit Court
of said County & upon pages 683 & 684 of said Book convey to the Board of Education
of the Seminary East of the Suwanne River all that lot in said town known
as block five (5) in Range eight (8) being three hundred and twenty feet (320 feet)
North and South by one hundred and ninety Seven (197) feet east and west as
designated in the Town map of said Town of Gainesville, and whereas by the
said deed the said lot was granted to the said Board of Education and their
Successors so long as said Seminary Should be established by law at said
Gainesville & receive her pro rata Share of the Seminary funds as provided by
law and upon the rennal of said Seminary from said Gainesville or upon
the failure of the State to Extend the fostering care and necessary aid to the
institution as indicated in the laws establishing two Seminaries in the State
then the property therein conveyed shall revert to the said J.H. Roper his
heirs and assigns Now this Indenture witnesses that the said J.H. Roper party
of the first part for and in consideration of the Sum of five dollars to him
paid and also in consideration of his regard to the people of said town
and with the purpose of promoting & extending education among the
people does hereby grant bargain sell and convey to the said Town of
Gainesville all the right title interest and claim which he has now or
which may hereafter accrue to him or his heirs should there a defeasance
occur according to the terms of the said deed to the said Board of
Education of the 1st of March AD 1866 and thereby a reversion of the
right and title to said lot to the said J.H. Roper or his heirs but this
conveyance is upon this condition & with the understanding that the said
lot and all the improvements that may be thereon shall be used and
appropriated only to Educational purposes that being the object and
design of the said J.H. Roper in the Conveyance to the said Board of
education and in this Conveyance to the Town of Gainesville In case the said
lot shoul not be used and appropriated as aforesaid by said
Town then it shall revert to and become the property of the Said
J.H. Roper and his heirs as in said deed of March 1 AD 1866
