all and singular the tenements hereditaments and
appurtenances to the same belonging or in any
wise appertaining  To have and to hold all
and singular the real and personal estate and
property above described unto him the said F.
J. Hammond in trust for the use and benefit of
all and every of my creditors generally whomsoever and
whomsoever they may be, and to his heirs and suc
cessors in the trust and to his and their assigns
forever said property to be disposed of as follows
by said Trustee viz  The said real estate to be
sold by said Trustee and converted into money or
its equivalent at such price and at such time
and upon such terms as he may said ass-
ignee and Trustee in his best judgment and
discretion shall deem best and proper for the
interest of all parties interested and the proceeds
of the said real Estate, and all moneys collected
on or out of or from, or on account of the
said Three Fire Insurance Policies, after paying
all attorneys fees, and the costs and expenses
incident to this assignment and appertaining
thereto in future, shall be paid over by my said
assignee and Trustee pro rata to among and
between all of my creditors generally in prop-
ortion to the amounts of their respective claims
against me. Provided that my said creditors
shall accept said pro rata payment whatever it
may amount to as payment in full of their
respective demands and claims against me
and upon such payment shall execute and
deliver to said assignee and Trustee receipts
and acquitances in full discharging and
releasing me from all further liability on account
of their respective claims and demands against
me - and should the proceeds of said real Estate
and personal property amount to more than
Enough to pay the whole of my indebtedness
generally, then, after the whole of my indebtedness
shall be paid and discharged in full out of
such proceeds the residue and balance left
thereof shall be returned to me = and for the
