This Indenture made this seventeenth day of November AD 1882 between
the Peninsular Rail Road of Florida party of the first part and
Edward N Dickerson of the City of New York party of the
second part. Whereas the party of the first part owns and is entitled to
receive from the United States of America and from the State of Florida
alternate sections of public lands lying and situated along the line
of the Rail Road owned by it between Waldo and Ocala in the
State of Florida and Whereas an agreement has been entered into
between the parties hereto whereby the party of the second part is to hold
such lands in trust for the uses and purposes in such agreement
set forth. Now therefore this Indenture Witnesseth that the party
of the first part in consideration of the premises and the sum of One dollar to it
in hand duly paid at and before the ensealing and delivery of
these presents the receipt whereof is hereby acknowledged hath
granted bargained sold conveyed and transferred and by these
presents does grant bargain sell convey and transfer unto the party
of the second part in trust as aforesaid all and singular the
Public lands which the party of the first part is entitled to
receive from the United States or from the State of Florida Whether
the same has been heretofore conveyed or may hereafter be conveyed to it
To Have and to Hold the said lands unto the party of the second
his assigns and heirs in trust nevertheless that the party of
the second part will sell and convey the same to purchasers upon
terms which may be agreed upon between the parties hereto and
to appropriate the proceeds thereof to the uses and purposes
specified in the said agreement between the parties. And the
party of the second part hereby agrees that he will hold and use
the said land for the uses and purposes in said agreement
contained and not otherwise and will make sales and
conveyances thereof upon the terms and in the manner which
may be agreed upon between the parties hereto and finally
that he will after satisfaction of the trust hereby created
convey the residue of such lands if any there be to such
party or parties as the party of the first part may in writing
direct In Witness Whereof the party of the first part has caused
its corporate seal to be affixed to these presents and the same to
be attested by the signature of its President; and the party of the
second part has hereunto set his hand and seal to testify his
acceptance of the trust herein contained
