said A.J. Vidal shall retain and withhold the bal-
ance of the purchase money for said property to wit:
the sum of Six hundred dollars until such time as
the said defect or irregularity in said title is cleared
up satisfactorily or removed, when the said balance of
six Hundred dollars is to be paid by the said A.J. Vidal
without interest - Therefore the premises considered this
agreement made and entered into on this day by
and between the said Oscar D. Morris and A.J. Vid
al both of the said town of Gainesville Florida Witn
esseth: That the said Oscar D. Morris hereby agrees
and binds himself and his heirs executors and admin
istrators promptly and as early as is practicable and
within Nine Months from the date hereof to clear
up and remove the said defect in the title to said
property either by the authorization and positive
ascertainment of the fact, which is currently re
ported that the said Mary A. Myers has departed
this life without having any children to distur
b said title, or if she or any Children of hers
be still alive to have said defect in said
title removed either by a perfect deed of quit
claim or by a proper and effectual decree of the
Court of Chancery X Upon the clearing up and
removal of which said defect in said title
then the said A.J. Vidal hereby binds himself and
his heirs executors and administrators at once
to pay to the said Oscar D. Morris the said sum
of Six hundred dollars the unpaid balance of
the purchase money for said property and
as security for the full and true payment of
said six hundred dollars according to the ter-
ms hereof the said A.J. Vidal hereby agrees
and stipulates that his instrument shall have
the force and effect and lein of a mortgage
upon the said Lot of land hereinbefore descr
ibed which has this day been conveyed as
aforesaid to him the said A.J. Vidal by him
the said O.D. Morris to be enforced and foreclosed
as and for a mortgage in the event the said
A.J. Bidal shall fail to pay said unpaid balance
of Six hundred Dolars as soon as the said de-
fect in the title to said lot of land shall be
cleared up or removed as aforesaid by the said
O.D. Morris. And it is hereby further stipulated and
agreed by and between the said parties that if
at the end of Nine (9) months from the date
of this instrument the said O.D. Morris shall
