find it utterly impossible legally to clear up or
remove the said defect in the title to said Lot of
land or to rectify the same then in that event
the said O.D. Morris hereby agrees and covenants and
binds himself and his heirs and assigns to pay
back to the said A.J. Vidal or to his heirs executors
and administrators the said sum of Twelve hun
dred and fifty Dollars this day received by him
the said O.D. Morris from the said A.J. Vidal with-
out interest - in which event and upon the repayment
of the said sum of Twelve hundred and fifty
$(1250.00) Dollars the said A.J. Vidal hereby
covenants and agrees and binds himself and his
heirs and executors and administrators to deliver up
to the said O.D. Morris the possession of said prem
ises and lot in the same condition as the same now
are usual wear and decay excepted and to recover
ey the said Lot of Land to the said O.D. Morris or
to his heir by suitable and properly executed Deed
of conveyance =X To the due and faithful perfor
mance of all of the terms stipulations covenants and
agreements herein contained the said parties do here
by solemely obligate and bind themselves and their
respective heirs executors and administrators firmly
by these presents. In witness whereof we have hereunto
set our respective hands and affixed hereto our
seals on this 8 day of May A.D. 1883.
