This Indenture made this twenty eighth day of Nov
ember AD One thousand and eight hundred and eighty three
between Charles W. Brush and Julia A. Van Ness the only
surviving heirs at law and divisees of Nehemiah Brush
deceased parties of the first part and William Bailey
and Clark S. Bailey of Alachua County and State of Florida Witness
eth that in consideration of the sum of ($250) Two
hundred and fifty Dollars paid by the said parties 
of the second part to the said parties of the first part
the receipt whereof is hereby acknowledged the said parties
of the first part do hereby grant bargain sell assign
Transfer and set over unto the said parties of the sec
ond part their heirs and assigns all that certain piece
or parcel of land situate and lying in section Eleven (11)
Township Nine (9) Range Twenty 20 in Alachua County
and State of Florida and described as follows that is
to say Lot Twenty one (21) of said section being part
of the west addition to the town of Fairbanks accor
ding to a plat of said addition recorded among the
Land Records of said Alachua County and containing twenty
(20) acres of land be the same more or less Being part
of the grant of land known as the Arredondo Grant and
which by decree of the Circuit Court of St Johns County
in said State of Florida in the case of Brush and others
against Prall and others dated August 11 1849 and
duly recorded in said Alachua County was adjudged
and set over to the heirs at law and devisees of the
said Nehemiah Brush deceased Together with all and
singular the estate right title interest claim and dem
and which the parties of thereto of the first part have in
and to the same To Have and to Hold the said described
piece or parcel of land with the appurtenances unto the
said parties of the second part their heirs and assigns
forever and the parties hereto of the first part severally
covenant with the parties of the second part hereto 
their heirs and assigns that they have not done any
act matter or thing to encumber the property hereby
conveyed and that for themselves respectively and for
their respective heirs the said premises and every part

heirs and assigns against every person lawfully claim
ing the same they shall and will forever warrant and
defend  In Testimony whereof the parties of the first
part have hereunto subscribed their names and
affixed their seals the day and year first herein
written
