veyed or located or to be surveyed and located
by the party of the second part on its line of Rail
way and which railway hereby granted and convey
ed is of the width of 120 feet aforesaid and the party
of the second part its successors and assigns has and
shall have the right and privilege in consideration
aforesaid and in consideration of its construction
and operation of said rail road to go beyond
the limits of the said 120 feet or way hereby gran
ted and released to drain said way and to keep
it drained and the parties of the first part coven
ants and agrees not to disturb or molest the party
of the second part its successor and assigns
servants agents or employees in the use and enj
oyment of the said way or privileges To have and
to hold the above granted premises and privileges
unto the party of the second part its successors
and assigns against all and every person or
persons lawfully claiming or to claim the by or
through the parties of the first part provided however
that if the party of the second part its success
ors or assigns shall not within six months from
the date hereof locate grade and tie its Rail
Road over or within the above described premises
this grant and conveyance to be wholly void
and of no effect In witness whereof the parties of
the first part have hereunto set their hands and seals

described in and who executed the foregoing instrum
ent and severally acknowledged the execution
thereof to be their free act and deed for the uses
and purposes therein mentioned and the said Cate
Merry the wife of the said C.N. Merry on an
examination taken and made separately and apart
from her said husband did acknowledge that
she made herself a party to the said deed for the
purpose of renouncing and relinquishing her dower
or right of dower and all other right and title
whatever in and to the lands tenements and hered
itaments therein described and thereby granted and
