the width of 120 feet aforesaid and the party of
the second part its successors and assigns has
and shall have the right and privilege in consid
eration aforesaid and in consideration of its constru
ction and operation of said railroad to go beyond
the limits of the said -- feet or way hereby granted
and released to drain said way and to keep drained
and the part of the first part covenants and
agrees not to disturb or molest the party of the
second part its successors and assigns servants
agents or employees in the use and enjoyment of
the said way or privileges to have and to hold the
above granted premises and privileges unto the
party of the second part its successors and ass
igns against all and every person or persons law
fully claiming or to claim by or through the parties
of the first part Provided however that if the
party of the second part its successors or ass
igns shall not within from date hereof locate
grade and tie its Rail Road over or within miles
of the above described premises this grant and
conveyance to be wholly void and of no exffect In
witness whereof the parties of the first part have
hereunto set their hand and seal the day and year

D. Barr his Wife to me known to be the persons des
cribed in and who executed the foregoing instrument and
severally acknowledged the execution thereof to be their
free act and deed for the uses and purposes therein
mentioned and the said Susan D. Barr the wife
of the said Jno J. Barr on an examination taken
and made separately and apart from her said hus
band did acknowledge that she made herself
a party to the said deed for the purpose of ren
ouncing and relinquishing her dower or right of
dower and all other right and title whatever in
and to the lands tenements and hereditaments therein
described and thereby granted and released and
that this deed and relinquishment or renunciation
of dower is made by her freely and voluntarily
