at a public sale of said Grant made for the purpose of partitioning
the same among the several owners thereof by Messers Payne Childs
& Forward on the twenty first day of February 1849 and several Successive
days thereafter and the sale made under the order of the Circuit Court
of St Johns County Florida and confirmed by the said Court at the June
term thereof in 1849 with the appurtenances and all the estate title
and interest of the said parties of the first part therein. And the said
parties of the first part do hereby covenant and agree with the said
part of the second part that at the time of the delivery hereof the
said parties of the first part are the lawful owners of the premises
above granted and siezed thereof in fee simple absolute and that
they will warrant and defend the above granted premises in the
quiet and peaceable possession of the said party of the second part
his heirs and assigns forever. In Witness Whereof the said parties of
the first part have hereunto set their hands and seals the day

of November 1850 before me a Commissioner appointed by the
Governor of Florida to take the acknowlement of Deeds &C in
the State of New York to be used in the State of Florida
personally appeared David Lee and Ann D. Lee his wife who
acknowledged severally that they had executed the within
conveyance for the purposes therein mentioned and the said
Ann D. Lee upon a private examination separate and apart
from her said husband acknowledged that she had executed
the same of her own free will & without fear or compulsion of
her said husband and I certify that I am acquainted
with the parties making this acknowledgement and Know
them to be the same persons described in and who executed
the within conveyance. In testimony of which I hereunto set
my hand and seal the day and year above written
