title interest and property in the same and to the lands 
therein mentioned so far as the same remain unconveyed 
and including in this assignment the conveyance here
in before mentioned made by the said Fernando de la Maza 
Aredondo to the said party of the first part with their 
and every of their appurtenances To have and to hold 
all and singular the premises above mentioned 
and described unto the party of the second part his heirs 
executors administrators and assigns forever to and for 
his and their sole use benefit and behoof forever - 
And the said party of the first part doth by these pre
sents nominate constitute and appoint the said party 
of the second part his executors administrators and 
assigns the attorney and attorneys irrevocable of the 
said party of the first part in the premises and doth 
hereby give and grant unto the said party of the 
second part his executors administrators and assigns 
full power and authority to ask demand sue for
have and receive from the said Fernando de la Maza 
Aredondo & Son Henry Thomas or from whomsoever ** 
these presents do shall or may concern  the conveyance 
of the land aforesaid now in the possession of the said 
Henry Thomas Or else to commence and prosecute suit 
or suits action or actions at law or in equity against the 
said parties Or either of them their heirs executors 
administrators under and in virtue of the agreement 
above mentioned and in particular for the conveyance 
of the lands therein mentioned and generally the full 
whole entire and absolute power and authority of the 
said party of the first part doth for himself his heirs
executors & administrators covenant promise and 
agree to and with the said party of the second
