Hercules Hannah and Mason unto the said John L 
Engle his heirs Executors Administrators and as
signs Forever Provided always nevertheless that if 
the said Ducan L. Clinch my heirs executors ad
ministrators or assigns shall and do well and truly 
pay or cause to be paid unto the said John L
Engle his certain attorney executors administrators or 
assigns the full and just sums of money in the said 
bonds mentioned according to the true intent and 
meaning of the same and the conditions thereof and of 
these presents together with lawful interest as therein 
provided then this deed bargain and sale and 
all and every cause article and thing therein 
contained shall cease determine and be utter
ally void and of none affect any thing herein 
contained to the contrary thereof in any wise not with
standing -- And it is hereby declared by and 
between the said parties and I the said Ducan 
L. Clinch for myself - my executors administrators 
and assigns do covenant promise and agree to 
and with the said John L. Engle his executors 
administrators and assigns by these presents 
that if defalt shall happen to be made 
of or in payment of the said bonds or the 
sum of money and interest as therein and
