Alachua aforesaid being the west half of the North
east quarter of section Two in Township nine south
of Range Eighteen east in the District of land subject
to sale at St Augustine Florida and containing
Eighty acres and sixty nine hundredths of an acre
being the same tract that was conveyed by the United
States of America to the said William Gibbons
by patents dated 5th March 1833 and by the
said Gibbons conveyed to the said Zilpha Caroline
Sanders by deed of quit claim dated
To have and to hold the said above
described tract or or parcel of land with all its
appurtenances unto him the said William Gibbons
party of the second part and heirs forever
Provided nevertheless and it is hereby
expressly agreed and understood by and between
the said parties that if the parties of the first
part shall well and truly pay and satisfy the
several above mentioned promissory notes as they may
respectively be payable according to the tenor of said
notes that then this deed of Indenture shall be null
and void or otherwise to remain in full force
and virtue And provided further and
it is expressly understood and agreed upon be
tween the respective parties to this (indenture or)
instrument that if the said parties of the first part
shall make failure in the payment of either
of either one of said notes above mentioned
on the on which it be came due or payable
and according to its tenor that then and in such
case it shall be allowed to the said party of the
second part or to his heirs or assigns to proceed
forthwith to the foreclosure of this mortgage at the
first term of any Court of Competent Jurisdiction |
