hereditaments and appurtenances to the said several 
tracts of land belonging or in any wise incident or 
appertaining  To have and to hold all and 
singular the said premises unto the said James Hibben 
Junior Trustee as aforesaid his heirs and assigns 
forever.   And I the said Thomas Napier do hereby 
bind myself my heirs executors and administrators to 
warrant and forever defend all and singular from 
and against me my heirs executors administrators and 
assigns and all other persons whomsoever lawfully 
claiming or to claim the same or any part thereof
   Provided always nevertheless and it is the true 
intent of and meaning of these presents, that if  I the 
said Thomas Napier shall and do well and truly 
pay and satisfy to the said James Hibben Junior Trustee 
as aforesaid or his heirs or assigns the debt of sum 
of miney aforesaid with the interest thereon as confirmed 
in the promissory note aforesaid then this deed of 
bargain and sale shall cease determine and be 
utterly null and ____ void otherwise it shall remain 
in full force and virtue
	In witness whereof I the said Thomas Napier have 
hereunto set my hand and Seal at Charleston aforesaid 
the twenty fourth day of January in the year of 
our Lord one thousand eight hundred and 
thirty eight
