This Indenture made the third day of May 1834
between Ducan L. Clinch Colonel in the Army of the United
States now of the City of Mobile of the first part and Martha
J.P. Bench of the City of New Orleans widow of Daniel E.
Bench late of New Orleans deceased by her legally constituted
Attorney Doct. J.P.C. Mahon of the second part Whereas the
party of the first part was, on the first day of October
1833 justly indebted to the said party of the second part
in the sum of thirteen thousand one hundred and ten 16/100
dollars (say $13 110.16) and whereas it was then agreed by and
between the said parties of the first and second parts that
the said party of the first part of the first part should retain
the use of said sum of money for and during the tenor
of six years from that date payable by annual installments
of one fifth part each year the first part to be paid
on the first day of October eighteen hundred and thirty
five and an annual Interest rate of seven per cent the said
interest to be paid annually on the whole sum with the
privilege secured to the party of the first part of pay
ing the said debt or any part thereof with the interest
at any time or times before the expiration of
the said period of credit with which the said party of
the second part declares herself to be content and whereas
the said party of the first part hath this day Executed
& delivered to the said party of the second |
