from Station 28 & 34 to Station 28 & 64 a distance of
30 feet. Containing 0.10 acres. Together with all
and singular, the tenements, hereditaments, and ap-
purtenances thereunto belonging or in anywise apper-
taining, and the reversions, remainder and remain-
ders, rents, issues and profits thereto and also all
the estate, right, title, interest, dower and right of
dower, property, possession, claim and demand whatsoever
of the said part of the first part, both in law and
in equity, of, in and to the above granted premises,
with the hereditaments and appurtenances. To have
and to hold the above granted premises, with the ap-
purtenances and every part thereof, unto the said party
of the second part, and its successors and assigns,
to its own proper use and behoof forever for the use
and purpose of the part of the second part for the
track and roadway for said Railroad, and the prop-
er appendages to such track and roadway, and for
the building thereon of depots, warehouses and other
structures required for the proper transaction of the bus-
iness of said Railroad Company. Provided always,
and these presents are upon the express condition,
that the said party of the second part shall con-
struct it railway and put it in operation.
