And now on this day came the
parties by their respective attorneys, and the defendant
saying nothing in bar or preclusion of the plain-
tiffs said action hereof against him, It is or-
dered by the Court that the said plaintiff do have his
judgment by default, and that the Clerk do
assess the damages, Whereupon the Clerk do
having assessed the damages at One hundred &
Seventy nine dollars and Seventy three cents It is fur-
ther ordered considered and adjudged by the
Court, that the said plaintiff do have and
recover of and from the said defendant the
said Sum of One hundred & Seventy nine Dollars and
Seventy three cents for his damages together with
his costs in this behalf expended taxed at
Five ------- Dollars and Seventy one cents

against him, It is ordered by the Court that
the plaintiff do have his judgment
by default and that the Clerk do assess the
damages, Whereupon the Clerk having assessed
the damages at Seventy one dollars and
nineteen cents, for his It is further ordered considered
and adjudged by the Court, that the said plain
tiff do have and recover of and from the said
defendant the said defendant the said sum
of Seventy one Dollars and nineteen cents
for his damages together with his costs in
this behalf expended taxed at Five
Dollars and Ninety five cents, and the de-
fendant in mercy &c
