came the parties by their respective attorney
and the defendant saying nothing in bar
or preclusion of the plaintiffs said action
hereof against him, It is Ordered by the Court
that the said plaintiff do have his judgement
by default for want of a plea, and that the
Clerk do assess the damages. Whereupon the
Clerk having assessed the damages at Four
hundred & thirty nine dollars and Seventy eight cents It is
futher Ordered, Considered and adjudged
by the Court that the Said plaintiff do have
and recover of of and from the said defendant the
said sum of Four $439.78/100 dollars and
twenty three Cents together with his costs in
his behalf expended taxed at Four --
