This cause coming on to be heard the death
of Joel B. Smith was suggested & Sci fa ordered to his

And now on this day came the
parties by their respective Attorneys and the defendants
Saying nothing in bar or preclusion of the plaintiffs
Said action hereof against him It is ordered
by the Court that the plaintiffs do have their Judg-
ment by default and that the Clerk do assess the
damages, Whereupon the Clerk having assessed
the damages at One hundred and thirty Six -----
Dollars and thirty two cents It is further or-
dered considered and adjudged by the Court
that the said plaintiffs do have and recover of and
from the said defendants the said sum of
One hundred and thirty Six Dollars and thirty
two cents for their damages, together with their
costs in this behalf expended taxed at
Five Dollars and forty five cents and
the defendant in mercy &c
