Joe H. McGinnis & Co. } Means
and now on this day came the parties by their
respective attorneys and the defendant saying nothing in bar
or preclusion of the plaintiffs said action hereof against him.
It is ordered by the court that the said plaintiff do have his
Judgment by default against the said defendant for want
of a plea and that the clerk do assess the damages.
Whereupon the clerk having assessed the damages at one thou-
sand one hundred ~~~~~~~~~~ Dollars and ~~~~~~~~~~~~~~~~
cents. It is further ordered considered an adjudged by the
court that the said plaintiff do have and recover of and
from the said defendant the said sum of Eleven
hundred ~~~~~~~~~ Dollars and ~~~~~~~~~~~~~~~~~~~~~~~~~~
for his damages together with his cost in this behalf
expended Taxed at Two Dollars and ninety five
and the defendant in mercy &c

by default for want of a plea and that the Clerk do assess
the damages. Whereupon the clerk having assessed the damages
at one hundred and sixty six Dollars and twelve ~~~~~~~
cents. It is further ordered considered and adjudged that
the said plaintiff do have and recover of and from the
said defendant the said sum of one hundred and sixty six
Dollars and twelve cents for their damages to-
gether with the further sum of two ~~~~~~~~ Dollars and
ninety five cents for their costs in this behalf expend-
ed and the defendant in mercy &c.
