Court met pursuant to adjournment Present his Honor the Judge

The State of Florida }
vs. } Assault & Battery with intent to Kill
Simon a Slave }
The said jury returned into court,
and upon their oath do say they find the said Simon
a Slave guilty of an Assault with intent to Kill, -- whereupon
the said prisoner was remanded back to jail.

And now on this day came the defendant
and files his demurrer to the said plaintiffs said declaration
herein filed, upon grounds therein Stated, and after argument by
Counsel, it is ordered by the Court that said demurrer be
Sustained, Whereupon upon motion of plff's attorney It
is ordered that said cause be dismissed, and that plain
-tiff have leave to withdraw papers upon payment of
costs.
