It appearing to this Court that the commission
issues to take testimony in this Cause has been improperly Exe-
-cuted It is ordered by the Court that the plaintiff have leave
to withdraw the Commission for Enxecution and that this cause
be continued until the next Term

And now on this day came the plaintiff
by his attorney and the defendants by Wm Bailey one of said
commissioners and issue being joined, thereupon came a
Jury to wit

3 Hardy Havard 9 Wiley S. Barnett
4 R.E. Johnson 10 John A. Dean
5 Franklin Cox 11 A.H. Perry
6 John R. Cason 12 Allen W. Hinson
who being duly sworn well and truly to try the issue joined
and a true verdict give according to law and Evidence
after hearing the testimony of witnesses argument of Counsel
and Charge of the Court retired to consider of their verdict
and thereupon afterwards to wit upon the same day Entered
into Court and rendered the following to wit We the Jury
find for the plaintiff and assess the damages at Forty two
Dollars and fifty cents, Whereupon It is ordered consider
ed and adjudged by the Court that the plaintiff do have
and recover of and from the said defendant the sum of
Forty Two Dollars and fifty cents for his damages together
with his costs in this behalf Expended Taxed at Five
Dollars and ninety five cents and the Defendant in mercy
&c
