said term so to him thereof granted and the said
John Doe being so thereof possessed the said
Richard Roe afterwards to wit on the 1st day
of May 1856 with force and arms and against
the peace of the State of Florida entered into
the said tenements with the appurtenances which
the said Philip Dell had demised to the said
John Doe in manner and for the term aforesaid
which is not yet Expired and ejected the said
John Doe from his said farm and other wrongs
to the said John Doe then and there did to the
great damage of the said John Doe and against
the peace of the State of Florida wherefore the
said John Doe saith that he is injured and hath
sustained damage to the value of $10,000 and
thereupon be brings his suit &c --
and the said Adam Clay tenant in possession
by McLin his attorney comes and says that he
is not guilty of unlawfully withholding the premises
claimed by the said plaintiff as alleged in
his said declaration and of this he the said
Adam Clay puts himself upon the Country and
the said plaintiff doth the like - Therefore the
issue above joined is ordered to be tried at the
Circuit Court appointed to be held at the Court
House in the town of Gainesville in and for the County of Alachua
aforesaid at the Spring Term 1857 of said Court commencing
on the Second Monday in May of the year A.D. 1857
and now at this day to wit the twelfth day of
May in the year of our Lord one thousand Eight hundred
and fifty seven before the said Honorable William A.
Forward of the Circuit Court aforesaid at the
Court house at Gainesville in the County of Alachua
aforesaid comes the said plaintiff by his attorney
aforesaid and the said Circuit Judge before whom
the said issue was tried hath sent hither his record
had before him in these words to wit: afterwards
that is to say on the day and at the place within
contained before the Honorable William A. Forward
within mentioned according to the form of the
Statute in such case made and provided came
as well the within named plaintiff as the within
named Adam Clay by their respective Attornies
within mentioned and thereupon came a Jury
