And now on this day came the parties
by their respective Attornies and thereupon
came a Jury to wit

3 R.E. Johnson 9 Jas M. Richardson
4 John A. Dean 10 Alexander H. Perry
5 Jeremiah Gamage 11 John P.C. Massey
6 John H. Malphers 12 James B. Bailey
And after hearing part of the testimony
on account of the illness of his Honor
William A. Forward presiding Judge the
Jury were discharged and the cause ordered
to be discharged
The Following Jurors regularly summoned
to wit James A. Turner
John B. Feaster
Wm H. Stringfellow; rendered
satisfactory excuses of illness of themselves
and family and were excused.
It appearing to the Court that
Oliver Bryant, Elijah Barrow, Thomas
W. Chesnut, Musco Boulware, did have been
duly and lawfully summoned to attend this
court as Jurors respectively and that they
have failed to attend the Said term of this
court in obedience to Said Summons and
therein default it is ordered that a rule
be Served upon them respectively returnable
to the next term of this court requiring them
and each of them to show cause why the Court
should not proceed to assess a fine against them
respectively for their said default |
