Bailiff to their room The following persons were excused
for the times and reasons hereinafter stated , viz Noble A. Str-
obhar & Robert O'Connor, Jr. The Court then proceeded to call
the Trial docket

Erroneous Entry 14th December A.D. 1857.
Now on this day came the parties by their respective
attorneys, and the defenant saying nothing in bar or preclusion
of the plaintiffs, said action hereof against him, It is ordered
by the court on motion of plaintiff

Merry, Childs & Co. } Judgment by Default, Writ of Inquiry
and now at this term of the Court came
the plaintiff by their attorney, and thereupon came a Jury
to wit 7 Willis Peacock

4 Peter W. Guinn 11 Tilman Ingram

6 John Sparkman Who being duly sworn
well and truly to assess the damages sustained by the
plaintiffs by reason of the nonperformance of the said
several promises in their said declaration mentioned
according to the evidence; after hearing the evidence
and argument of Counsel, and charges of the Court
retired to consider of their verdict, and afterwards
upon the same day returned into Court and ren-
dered the following verdict to wit: We the Jury assess
the damages at Dollars
and cents Wherefor It is ordered
considered and adjudged by the Court that the
plaintiff do have and recover of and from the de-
fendants the sum of Dollars and
cents for their damages, together with
their costs in this behalf paid said out and expended
Taxed at Dollars and cents and the
defendant in mercy &c |
