And now on this day came the said
Plaintiff by his attorney Bradford & McLin Esqr and the
said defendant came by his attorney and says nothing
but makes default, And wherefore the said plaintiff prays
Judgement for want of a plea, and that the Clerk assess
the damages & the Clerk having assessed the damages by reason of the premises at the sum of
Thirty Eight -- Dollars & Fifty one Cents Therefore it
is considered by the Court that the said Plaintiff do
recover of the Said defendant the sum of Thirty
Eight Dollars & Fifty One -- Cents so as aforesaid
assessed against him with interest Thereon untill paid
together with the further sum of Dollars &
Cents for his costs in this behalf expended and
the said defendant in mercy &c
Ordered that rule be served upon Each
of the following named persons who have been summoned
to attend at this term of the Court as Jurors & who have
failed to do so, to be returnable to the next term
of this Court to show cause on oath why they and Each
of them should not be fined for non-attendance that is
to say William Mott, W.D. Clark Excused Julius A. Turnipseed
Francis R. Polk Excused Stephen Fagan John Townsend John R.W.
Grisom W. Wash Scott, Wm S. Perry
In consequence of the failure of attendance
of sufficient Jurors summoned on the original venire
to constitute a petit Jury ordered that a special
venire be issued and that the Sheriff forthwith summon
twenty residents of the county house holders under the
age of sixty years to serve as petit Jurors for this
term of the Court
