          Wednesday  Dec 16th  1857

therefrom the issue above joined is ordered to be tried
at the Circuit Court appointed to be held at the
Court House in the town of Gainesville in and for
the County of Alachua aforesaid at the Fall Term
1857 of said Court commencing on the second Monday
in December on the year of 1857, and now at this
day to wit the sixtenth day of December in the
year of our Lord Eighteen Hundred and fifty seven
before the said Honorable Benjamin A. Putnam Judge
of the Circuit Court aforesaid at the Court House in
Gainesville in the County of Alachua aforesaid comes
the said plaintiff by his attornies aforesaid, and
the said Circuit Judge before whom the said issue
was tried hath sent hither his record had before
him in these words to wit, afterwards that is to
say on the day and at the place within contained
before the Honorable Benjamin A. Putnam within
mentioned according to the form of the Statute
as such case made and provided comes as well
the within named plaintiff as the within named
Thomas Fraser by their respective attornies within
mentioned and thereupon came a jury
To wit --
1   Daniel  Lynn          5   Isaac Roundtree          9   Tillman Ingram
2   William S. Perry      6   James T. Thomas         10   Daniel C. Hart
3   Valentine R. Prevatt  7   John J. Turner          11   J.M. Croxton
4   Willis Peacock        8   John W. Peacock         12   James M. Ellis

who being chosen tried and sworn to speak the truth of
the matter within contained and truly try the issue joined
between the parties after having heard the testimony
of witnesses the argument of Counsel and the charge
of the Court retired to consider of their verdict and
thereafter to wit on the same day returned into court  and
rendered the following verdict  "Defendant Guilty "
and assess the damages at one cent
Therefore it is considered that the said plaintiff
do recover against the said Thomas Fraser
the possession of the said premises according
to the verdict of the said jury, and it is further
considered that the said plaintiff do recover
against the said Thomas Fraser his damages
costs and charges by the jury aforesaid in form 
aforesaid assessed and alao the sum of
