           Monday May 9th 1859

                      And now on this day came the
parties by their respective Attornies and the defen-
dant saying nothing in bar or preclusion of the 
plaintiffs right to recover.  On motion of Plaintiff 
Attorney it is Ordered that the plaintiff do have his 
Judgement against the defendant by default and 
that the Clerk do assess the damages.  Whereupon the 
Clerk having assessed the damages at One hundred
Eighty nine    Dollars & Forty ---- cents It is ordered 
considered & adjudged by the Court that the pla-
-intiff do have & recover of and from the defendant 
the said Sum           of                 Dollars 
&             cents for his damages together with his 
costs in this behalf expended taxed at Five     
dollars &        cents and the 
                 Defendant in mercy &c

                 And now on this day came the 
parties by their respective Attornies and the defendant
saying nothing in bar or preclusion of the plaintiffs right

that the plaintiff do have his Judgement against 
the defendant by default and that the Clerk do assess 
the damages.  Whereupon the Clerk having assessed 
the damages at One hundred & Twenty nine      Dollars
& Thirty nine   cents It is Ordered, considered & adjudged 
by the Court that the plaintiff do have & recover
of and from the defendant the said sum of
              Dollars &               cents together with
for his damages together with his costs in this be-
half expended taxed at Three
     Dollars & Ninety five cents
       and the defendant in 
                          mercy &c
