    Tuesday  May 11th  1858
and tenements for the use of the State of Florida, If the said
James M. Hawthorn, Samuel Swindle & Anderson Philpot
who stand Indicted for Riot, Shall fail in performing
the following Conditions that is to say That is to say That
you James M. Hawthorn Samuel Swindle & Anderson Philpot
Shall personally appear & answer said indictment at the
next term of the Circuit Court of the Eastern Circuit of the State
of Florida to be held at the Court House at Gainesville in the
County of Alachua on the Second Monday in December
next & abide the ordered of the Court in the premises & shall
not depart without leave of said Court then his Recognizance
to be void otherwise to remain in full force & effect

                  And now on this day came the parties by their
respective attornies and thereupon cane a Jury to wit

4  William H. Ellis             10  L.L. Watson

who being duly sworn well and truly to try the issues joined between
the parties on motion of plaintiffs attorney leave was granted
to with draw a Juror, and on motion it is ordered that
this Cause be Continued untill next term

                 And now on this day came the parties by their
respective attornies and the defendant Saying nothing in bar
or preclusion of the plaintiff do have his Judgement against
the defendant by default and that the Clerk do asses the
damages Whereupon the Clerk having assessed the damages
at Seventy three        dollars & Forty two           Cents
It is ordered Considered and adjudged by the Court that the
plaintiff do have and recover of and from the defendant the
said sum of Seventy three dollars   forty two
Cents for his damages together with his Cost in this behalf Expended
taxed at  four      dollars & Ninety four Cents
and the defendant in Mercy &c
