             Friday May 13th 1859

and that the Clerk do assess the damages Whereupon the 
Clerk having assessed the damages at One hundred & Sixty
 four        Dollars & Ninety Eight           cents
It is ordered considered & adjudged by the Court
that the plaintiff do have & recover of and from the defen-
=dant the said sum of  Doll Three           Dollars
 & Thirty             cents For his damages together with 
his costs in this behalf expended taxed at
           Dollars &         cents and the 
         Defendant in mercy &c

                 }  And now on this day came the parties 
by their respective Attys and the defendant saying nothing 
in bar or preclusion of the plaintiffs right to recover 
On Motion of the plaintiff Atty It is ordered that the plain-
tiff do have his Judgment against the defendant by default and 
that the Clerk do Assess the damages Whereupon the Clerk 
having Assessed the damages at  Seventy three
               Dollars &   Sixty Six             cents
It is Ordered, considered, & adjudged by the Court that 
the plaintiff do have and recover of and from the 
Defendant the said sum of                      Dollars 
&                cents for his damages together with 
his costs in this behalf expended taxed at    Six
         Dollars & Thirty Eight    cents and the 
       Defendant in mercy &c

It is Ordered, considered & adjudged by the Court
that the plaintiff do have & recover of and from the defen-
-dant the said sum of   Five                    Dollars
&  cents  Sixty Six   cents for his damages together with 
his costs in this behalf expended taxed at
                Dollars &                                cents
