Court
This Cause was brought by defendant William
Axer from a Judgement of a Justice of the peace upon
Certiorari assigning as error, that three Suits were
instituted the Same defendant & at the Same time Each
note is for an amt less than $50 but all the notes in
the aggregate exceed $50 This Cause was argued
at the Court at Gainesville during the Spring Term & the
point was reserved by the Court The decision to be made &
entered as of the Spring Term of said Court & have examined
the question reserved and there is no error on the ground
assigned by the defendant on the record & Judgement of
the Justice ~~ The Certiorari is dismissed at defendants Costs,
Let this Judgt be entered as of the Spring term 1859

by their respective attornies, and the defendant Saying nothing in
bar or preclusion of the Plaintiffs right to recover On motion Plaintiffs
Attorney it is ordered that the plaintiff do have his Judge
ment against the defendant by default and that the
Clerk do assess the damages Whereupon the Clerk having
assessed the damages at One hundred & twenty three dollars
Seventy Eight Cents It is ordered considered and adjudged
by the Court that the Plaintiff do have and recover of and
from the defendant the Said Sum of One hundred and
twenty three dollars & Seventy Eight Cents For his damages
together with his Cost in this behalf expended taxed Seven
dollars & thirty five Cents and the defendant in
mercy &c
