James Tindal } McDonell Dawkins and McCall
for prisoner
And now on this day came the plaintiff by
Saml B. McLin Solicitor who prosecutes the pleas
of the state in this behalf as well also as the
prisoner by his Council, and after being formerly
arraigned prisoner pleads not guilty and puts
himself the Country, and thereupon came a
Jury to wit 5 Wm D. Clark
1 Inacious Griffin 6 Fleming Benton 9 Jacob G. Stroble
2 Frederick S. Roux 7 James Moore 10 Preston Wethersby
3 Robert E. Johnson 8 Arthur J. Moore 11 Gray Freeman
4 Alexander Matheson 12 Hope H. Colson
who being elected tried and sworn the truth of and
upon the promises to speak and who having heard
the testamony of ar J.M. Valentine E.S. Gunnell
J.H. Williams William A. Johnson and Tabitha
Bradshaw and having heard the testamony partly
produced on the part of the prosecution
the Court thereupon adjourned,

The Court met this morning
pursuant to adjournment, this case was
ordered on by the Court for trial, and
after further testamony upon the part of the
prosecution argument of Council and
Charge of the Court retired to consider
of their verdict and the charge the sworn
Bailiff of this Court, the said Jury returned
into Court and upon their oath do say that
they find the said James Tindal was not
guilty, whereupon the said prisoner was
remaded back to jail and an order passed
to his honor B.A. Putnam Judge for his final
discharge
