who having returned under direction of the Court
to Solicit their foreman there after and upon the same
day returned into Court and reported Elias Earl to
be their choice as foreman he was duly appointed and
approved by the Court as foreman, whereupon the said
Elias Earl was duly Sworn to discharge the business his
duties as foreman as aforesaid who having received his
charge of the Court retired under charge of the Court
John J. Turner who was duly sworn as Bailiff of said Jury
for the term to deliberate upon such business as might
be brought before the Court them
                                The Court then proceeded
to call the trial docket

                    And now on this day came the parties
by their respective Attornies and the defendant Saying nothing in
bar or preclusion of the plaintiffs right to recover, it is ordered
that the plaintiff do have his Judgement against the defendant
by default & that the Clerk do assess the damages Where
upon the Clerk having assessed the damages at
                  Dollars &                 Cents it is  
ordered Considered & adjudged by the Court that the
plaintiff do have and recover of and from the defendant
the said sum of                            Dolls
&                   Cents for his damages together with
his Cost in this behalf expended taxed at
            Dollars &                Cents and the
defendant in mercy &c
