And now on this day Came the
parties by their respective Attornies, and the defendant
Saying nothing in bar or preclusion of the plaintiffs
right to recover it is ordered that the plaintiff do
have his Judgement against the defendant by default
& that the Clerk do assess the damages Whereupon
the Clerk having assessed the damages at
Four hundred & thirty Eight Dollars & Seventy five Cents
it is ordered Considered & adjudged by the Court
that the plaintiff do have and recover of and from
the defendant the Said Sum of Four hundred &
thirty Eight Dollars & Seventy five Cents
for his damages together with his Cost in this behalf
Expended taxed at Nine Dolls &
Cents and the defendant in Mercy &c
